1. Acceptance of Terms

This website located at https://peakscalemarketing.com (the “Site”) is owned and operated by Peak Scale Marketing Inc. (“Peak Scale,” “Company,” “we,” “us,” or “our”). By using the Site or our services, in any manner, whether automated or otherwise, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms that may apply to specific sections of the Site or to products and services available through the Site or from Peak Scale.

We reserve the right to change these Terms of Service or to impose new conditions on the use of the Site from time to time, in which case we will post the revised Terms on this page and update the effective date above. By continuing to use the Site after we post any such changes, you accept the Terms of Service as modified.

2. Use of Website

You agree to use the Site for lawful purposes only. You may not use the Site to transmit any harmful or malicious content, or interfere with the Site's normal functioning, or in a manner that infringes the rights of Peak Scale or any third party.

3. Our Services

Peak Scale provides marketing and lead generation services to businesses, including the generation of consumer inquiries (“Leads”) in the consumer debt relief, life insurance, and related industries, primarily through digital advertising and landing pages. Any information shared on the Site is for informational purposes only and does not, by itself, constitute a binding agreement. Where you enter into a service agreement with us, the specific terms will be set out separately, and will govern in the event of any conflict with these Terms.

4. SMS Messaging Terms & Compliance

4.1 Program Description

Peak Scale operates two categories of SMS messaging programs, depending on how and where you provided your phone number and consent:

• Transactional messages: sent to individuals or businesses who have booked an appointment or consultation with Peak Scale through the Site or our scheduling forms, and who have opted in to receive SMS notifications. These include scheduling confirmations, appointment reminders, rescheduling updates, and customer support communications.
• Marketing messages: sent only to individuals who have separately opted in to receive promotional or marketing text messages, for example through a Peak Scale advertising landing page. Opting in to transactional messages alone does not enroll a number in marketing messaging, and vice versa.

Opt-in for each category is collected via web forms with a dedicated checkbox or equivalent affirmative action for SMS consent.

4.2 Cancellation Instructions

You can cancel SMS messages at any time by texting “STOP” to the number that sent you the message. We will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages of that category from us. To rejoin, opt in again as you did initially.

4.3 Support Information

4.4 Carrier Liability & Rates

Carriers are not liable for delayed or undelivered messages. Message and data rates may apply for messages sent to and from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text or data plan, contact your wireless provider.

4.5 Supported Carriers

Our SMS program is designed to work with major Canadian wireless carriers (including Rogers, Bell, Telus, and Freedom Mobile) and, for messages sent to U.S. numbers, AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

4.6 Age Restriction

You must be 18 years of age or older to participate in our SMS program.

4.7 Compliance

We aim to comply with applicable laws and regulations regarding SMS communications, including Canada's Anti-Spam Legislation (CASL) and CRTC rules, and, to the extent applicable, the U.S. Telephone Consumer Protection Act (TCPA) and CTIA guidelines.

4.8 Privacy

5. Intellectual Property Rights

5.1 Our Limited License to You

This Site and all materials available on it — including logos, branding, text, graphics, and software — are the property of Peak Scale and/or our affiliates or licensors, and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal, non-commercial use. Unless explicitly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works from, exploit, or distribute in any manner or medium any material from the Site. You may download and/or print one copy of individual pages for personal, non-commercial use, provided that all copyright and proprietary notices remain intact.

5.2 Your License to Us

By posting or submitting any material (including comments, blog entries, social media posts, photos, or videos) to us via the Site, internet groups, or other digital venues, you represent that you own the material or have obtained the necessary permissions. You grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, modify, transmit, sell, exploit, create derivative works from, distribute, and publicly perform or display such material.

6. Disclaimers & Limitation of Liability

Throughout the Site, we may provide links and pointers to internet sites maintained by third parties. Our linking to such sites does not imply an endorsement or sponsorship of the information, products, or services offered on or through them, and we are not responsible for their content or practices.

The information, products, and services offered on or through the Site are provided “as is” and without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose. We do our best to ensure the accuracy and reliability of information on the Site but make no guarantees, and we are not liable for any direct or indirect damages resulting from your use of the Site or our services.

You agree to indemnify and hold harmless Peak Scale, its affiliates, and their respective officers, directors, agents, and employees from any claims, causes of action, damages, liabilities, costs, and expenses arising out of or related to your breach of any obligation, warranty, or representation under these Terms.

7. Online Commerce & Third-Party Vendors

Certain sections of the Site may allow you to purchase products or services from third-party vendors, or may connect you with a third-party business partner in response to a Lead you submitted. We are not responsible for the quality, accuracy, timeliness, reliability, or any other aspect of these products or services. If you make a purchase from a third party linked through the Site, information obtained during your visit — including payment information — may be collected by both the merchant and us. Your dealings with any such third party are solely between you and that party, and Peak Scale is not responsible for any loss or damage arising from those dealings.

8. Registration & Accounts

To access certain features of the Site, you may be required to register and create an account. You agree to provide accurate, current, and complete information during registration, and are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. If you suspect unauthorized use of your account, notify us immediately at [email protected]. We are not liable for any loss or damage arising from your failure to comply with this obligation.

9. Payment & Refund Policy

If you enter into a service agreement with us, payment terms will be outlined in that separate agreement. Unless stated otherwise in writing, payments are non-refundable.

10. Termination

We reserve the right to restrict, suspend, or terminate your access to the Site or our services at any time, without notice, if we determine you have violated these Terms or engaged in conduct we deem inappropriate or unlawful. Upon termination, you must cease all use of the Site and any content obtained from it.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively through binding arbitration in Ontario, Canada, except where applicable consumer-protection law provides otherwise.

12. Changes to These Terms

We may update these Terms of Service from time to time. The latest version will always be available through Peak Scale with a current effective date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
