Privacy Policy
Effective Date: September 1, 2026
This Privacy Policy describes how Peak Scale Marketing Inc. (“Peak Scale,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards personal information when you visit https://peakscalemarketing.com (the “Site”), submit an inquiry, booking, or lead form on the Site or on a Peak Scale-operated advertising landing page, or otherwise interact with us, including through sales, marketing, or events. It replaces all prior versions of the Privacy Policy posted at peakscalemarketing.com.
If you do not agree with this Policy, please do not use our Services. If you have questions or concerns, contact us using the details in the “Contact Us” section below.
Peak Scale does not share the fact that a phone number opted in to receive SMS messages from us, or the associated consent record, with any affiliate or third party for marketing, promotional, or other purposes unrelated to providing the messaging service you opted into. This specific “text messaging originator opt-in data” is kept strictly confidential and is only shared with subcontractors who help us deliver the SMS messages themselves (for example, SMS gateway or aggregator providers). See “SMS Messaging & Compliance” below for the full SMS terms, and “Information Sharing & Disclosure” for how other information you submit — such as through a lead form — may be shared with business partners to fulfill your request.
All personal information you provide must be true, complete, and accurate, and you must notify us of any changes.
We use the information we collect to:
Where we rely on your consent for a purpose — including sharing your lead information with a business partner, or sending marketing messages — you may withdraw that consent at any time; see “Your Rights & Choices” below.
If you are located in Canada, we process your information where you have given specific permission (express consent), or where your permission can reasonably be inferred (implied consent). You may withdraw consent at any time. In limited circumstances, applicable law permits us to process information without consent — for example, for fraud investigation and prevention, to comply with a subpoena or court order, in connection with a business transaction, or where the information is publicly available.
By opting in to our SMS messaging program, you agree to receive text messages related to the service you engaged with — which may include appointment reminders, customer support, and account or service updates, and, only if you separately opt in, promotional messages.
Reply “HELP” for assistance, or contact us at [email protected] or (289) 514-5830 during business hours.
Text messaging originator opt-in data and consent records are not shared with any third party for marketing or promotional purposes. This data may only be shared with subcontractors who support delivery of the messaging service itself (for example, SMS aggregators), solely for that purpose. This protection is specific to the SMS opt-in record itself and does not limit the sharing of other lead information described in Section 5 below.
We do not sell, rent, or trade personal information to data brokers or for purposes unrelated to fulfilling the service you requested. We may share information as follows:
A core part of our business is connecting people who respond to our advertising campaigns with third-party businesses that can provide the debt relief, life insurance, or related service requested. When you submit a lead form, the information you provide is shared with one or more pre-selected, vetted business partners for the purpose of contacting you about that service, and may be routed through third-party lead distribution platforms to partners in Canada, Australia, or other markets we serve. This may constitute a “sale” or “sharing” of personal information under certain privacy laws — see “U.S. State Privacy Rights” below for the applicable opt-out.
Text messaging originator opt-in data and consent records are excluded from all of the above categories except SMS delivery aggregators/providers, consistent with Section 4.
We use cookies and similar technologies (such as web beacons and pixels) to analyze site traffic and user behavior, remember your preferences, improve website functionality, and measure the effectiveness of our services. We also permit service providers to use these technologies for analytics and advertising, including tailoring ads to your interests. We may share information with Google Analytics for this purpose; you can opt out at https://tools.google.com/dlpage/gaoptout or manage ad personalization at https://adssettings.google.com/. You may control cookies through your browser settings, though disabling them may limit certain website features.
We retain personal information only as long as necessary for the purposes described in this Policy, unless a longer period is required or permitted by law (for example, tax or accounting requirements). Where retention is no longer necessary, we delete or anonymize the information, or, where that isn't immediately possible, securely isolate it from further processing until deletion is possible.
We implement and maintain reasonable security measures to protect your personal information, including:
Despite these measures, no method of transmission over the internet or electronic storage is 100% secure. We use commercially reasonable means to protect your information but cannot guarantee absolute security.
We do not knowingly collect or solicit personal information from, or market to, children under 18 years of age, nor do we knowingly sell such information. By using our Services, you represent that you are at least 18, or that you are the parent or guardian of a minor and consent to that minor's use of the Services. If we learn that personal information from someone under 18 has been collected, we will delete it and deactivate any associated account. If you believe a child under 18 has provided us with personal information, contact us at [email protected].
Depending on where you live, you have the right to:
To exercise these rights, contact us using the information in “Contact Us” below.
Most web browsers and some mobile platforms include a “Do Not Track” (DNT) signal. Because no uniform standard for recognizing DNT signals has been finalized, we do not currently respond to DNT signals or similar mechanisms.
If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have rights under applicable state privacy law, including rights to know, access, correct, delete, and obtain a copy of your personal information, and to opt out of the sale or sharing of personal information or of certain profiling.
As described in Section 5, we may share lead inquiry information with business partners in a manner that could constitute a “sale” or “sharing” under certain state laws. You may opt out of this sharing by contacting us at [email protected]; doing so will limit our ability to connect you with a business partner in response to a lead inquiry.
You may designate an authorized agent to exercise these rights on your behalf, subject to identity and authority verification. If we decline a request, you may appeal by emailing [email protected]; if your appeal is denied, you may contact your state attorney general. California residents may also request, once per year, information about categories of personal information disclosed to third parties for direct marketing purposes under California's “Shine the Light” law.
We collect and process personal information in accordance with Australia's Privacy Act 1988 and New Zealand's Privacy Act 2020. You may request access to or correction of your personal information using the contact details below. If you believe we have unlawfully processed your personal information, you may lodge a complaint with the Office of the Australian Information Commissioner (oaic.gov.au) or the Office of the New Zealand Privacy Commissioner (privacy.org.nz).
